GENERAL BOOKING CONDITIONS

These General Booking Conditions govern the relationship between Searly Srl, with registered office in Porto Cervo, Loc. Farina SNC, 07021 Arzachena (SS), Italy, email: info@searly.com (“Searly”), and the customers (“Client/s”) who book stays through the website www.searly.com.

1. Object of the Contract

Searly acts as an intermediary between property owners and Clients. The rental agreement is finalized directly between the Client and the property owner.

2. Duration of Stay and Contract Type

• Short-Term Rentals: These General Conditions apply primarily to bookings for tourism purposes with a duration of less than 30 days, in accordance with current Italian legislation (Art. 4, D.L. 50/2017).

• Long-Term / Transitional Rentals: Searly is open to inquiries/bookings for periods exceeding 30 days. In such cases, these conditions govern the initial inquiry phase, but the parties commit to entering into a separate agreement and contract for transitional rental (or other legal types), which will be regulated according to current laws.

3. Prevalence of Special Conditions

Any special conditions that deviate from or supersede these general terms may be expressly agreed upon between the parties in writing, or be clearly described and indicated on the specific property page on the Website. In the event of a conflict, the specific property conditions or those agreed upon ad hoc shall take precedence over these general clauses.

4. Booking Procedure

To confirm a booking, the Client must select the property, enter the dates, provide payment details, and accept these Conditions as well as the Rental Agreement that will be presented during check-in or via digital signature.

5. Payment

• Deposit: A 25% deposit of the total amount is due at the time of booking.

• Balance: The remaining 75% must be paid at least 30 days before the check-in date.

• Last Minute: For bookings made within 30 days of arrival, the full payment is required in a single installment.

6. Cancellations and Modifications

Cancellation conditions are specified during the booking process. Any eligible refunds will be processed within 30 days of the cancellation date.

7. Arrival and Departure (Flexible Times)

• Check-in: The standard check-in time starts from 3:00 PM (15:00). The Client must communicate the estimated arrival time at least 8 hours in advance.

• Check-out: The standard check-out time is by 10:00 AM.

• Note on Flexibility: The times mentioned above are standard reference times. However, the times and procedures specified in the individual property description or expressly agreed upon with Searly will always prevail.

8. Security Deposit

If required, the deposit amount will be indicated during the booking process and refunded within 14 days after the end of the stay, subject to a property damage inspection.

9. Client Obligations

The Client agrees to occupy the property in compliance with the law, building regulations, and rules of civil coexistence. Subletting is strictly prohibited, and the property must be returned in good condition.

10. Liability

Searly is not liable for damages, thefts, or accidents occurring during the stay, although it guarantees maximum assistance in resolving any technical issues related to the property.

11. Jurisdiction

For any dispute arising from these conditions, the exclusive jurisdiction shall be the Court of Tempio Pausania (SS), Italy.
